New Delhi: In a recent development in the alleged fraud case between SES and a few channel partners in Tamil Nadu, SES has sent a legal notice to four partners. The vendor claims that these partners have not made payments of bills that are allegedly around two years old. But one of the accused partners has termed the unpaid bills are forged ones. Observing the situation, Confed-ITA has requested its members not to deal with vendors or distributors that are not professional. It is being reported that the association is likely to ban SES in the state of Tamil Nadu.
Vijay of Emerald Info Systems, Akhilesh Chandoke of Chandoke Systems and CP Praveen of Vasavi Computers are among the partners that SES had accused for withholding payments.
Not only has SES served legal notices to Confed members, it is also denying charges of the fraud executed by its employee and has also directed Confed not to interfere in the matter which is sub judice. Executive members of Confed-ITA informed that SES has also said that it would claim business losses if the association disturbs its normal business.
“SES has been sending notices to dealers but they are not giving any justification about their missing branch manager who was himself involved in the scam. This is not a professional approach to the business. SES has no control over its employees and now when one of them has taken the unfair path, SES is slapping a legal notice to the dealers instead of finding the truth from its own people. The distributor is not ready to speak to the association and they are asking to meet them directly at the court room. Seeing their approach, Confed-ITA is planning to ban SES in Tamil Nadu,” said Prasad.
When the executive members of Confed-ITA demanded a clarification from SES about the forged bills, the distributor asked them to prove that the bills are forged in court.
Questioning the authenticity of the allegations Prasad questioned, “If the cases of pending bills are two years old, why is SES seeking for payments now. They should have asked for the money two years back only. What is the reason that now only they got to know about the unpaid bills.”
Confed-ITA is also requesting vendors like Intel to stop dealing with SES for their unprofessional approach.
In a meeting that was held a month back between Confed-ITA and SES, the distributor had mentioned that since they have evidence of the billing that was done with the channel partners and the material was supplied to them they would collect the payments. The disti claimed that if the partners had any doubt about the involvement of any fraudulent activities, they could take legal action to investigate the matter.
CP Praveen, CEO, Vasavi Computers, one of the partners who received the notice, informed that since they have not done any fraud with SES and are correct in their business approach, they would reply to SES and would fight the case in the court.
When contacted, Suresh Tuteja, GM-Finance, SES Technologies said, “We have sent legal notice to four partners on the grounds that they had purchased material from us and the payment has not been made. Confed-ITA need not be taking any decision on this. The notice has been sent under Indian Penal Code Sec (138). Now whatever the court decides should be acceptable to everybody. Since the matter is sub judice we cannot give details.”
Tuteja informed that SES has no issues with Confed-ITA and the matter is only about the non-payment of material by few channel partners, and a decision would now be taken by the legal authority.
